Visa Bulletin – Priority Dates for March 2010

The Department of State Visa Bulletin provides the summary of the updates on the current cut-off date for the month of March 2010. Petitions filed, whose current dates are earlier than the dates indicated below, are now allocated visas or green cards. A priority date that is current but retrogressed would mean that the applicant needs to wait until it becomes current again.

    I am an consultant and my GC process was initiated last year 2009 in EB3 category, Got I-140 approved this month and 3.0 yrs H1B remains. My queries are related to change of employer –

    1) Can I change the employer by using simple H1B transfer to new employer or is there any other legal paper work that new employer would need? Do current employer need to keep I-140 valid for me to work for new employer?
    2) If I do not care about priority date or current GC process. Then can new employer start a fresh PERM and fresh GC process for me? if yes, can new employer wait for 6-8 months or even a year before initiating the GC process because there will still be time left on my H1B? or fresh GC process should be initiated immediately?

    It would be a great help to get clarity on my possible options for change of employer.

    Be careful with GC/PERM cases as well as H1B cases. Department of Labor is slower than ever! My case has been in DOL since Sept 2008!
